Donald Trump's administration is already looking for excuses and scapegoats as it attempts to fulfill the president's massive promises, a conservative legal scholar said on Saturday.
Ed Whelan, who has a lengthy credentials list as a conservative legal scholar at the Ethics and Public Policy Center, and as a supporter of Trump's policies, took to social media over the weekend to float a theory about Trump's immigration plans.
Specifically drawing attention to Trump's attempts to use the Alien Enemies Act to deport people, Whelan said, "The due process required for deportations under Trump's Alien Enemies Act proclamation is much greater than due process for ordinary deportations."

"Any detainee facing deportation under AEA proclamation should be able to (1) challenge the lawfulness of the proclamation, and (2) contest factual basis for his designation as a member of TdA gang," he added before asking, "Is there any good reason that Trump administration continues to insist on AEA deportations?"
Whelan continued, questioning whether Trump is serious about his flagship political policy.
"If Trump administration were serious about deporting as many illegal aliens as possible, it would be doing everything it could to improve and expedite the ordinary deportation processes, not wasting its time on probably illegal Alien Enemies Act proclamation that would apply to 1/10,000 of the illegal aliens, all of whom could be deported through other means," he wrote. "It's almost as if it's looking for excuses for failure and scapegoats to blame."
