A New Jersey House Democrat has been formally indicted by a federal grand jury for allegedly assaulting federal agents outside a U.S. Immigration and Customs Enforcement (ICE) facility in Newark last month.
U.S. Rep. LaMonica McIver (D-NJ) joined two of her House colleagues, Newark Mayor Ras Baraka and others in attempting to “inspect” the Delaney Hall federal facility in Newark on May 9. The group claimed they were performing their congressional duties and demanded immediate access to the facility, which was denied.
After an exterior gate opened to let a vehicle through, the group stormed inside and attempted to enter the facility. Federal agents soon arrested members of the group, including Mayor Baraka, for trespassing as they tried to clear the scene.
Officer-worn bodycam footage appears to show Rep. McIver shoving and body-slamming federal agents as they made the arrest. In one still, the Democrat congresswoman appeared to be winding up a punch.
On May 19, acting U.S. Attorney for the District of New Jersey Alina Habba announced that charges would be forthcoming against McIver. “Representative LaMonica McIver assaulted, impeded, and interfered with law enforcement in violation of Title 18, United States Code, Section 111(a)(1). That conduct cannot and will not be overlooked. Today my office has formally charged Representative McIver with violating that statute,” Habba announced in a press release.
“The charges stem from an incident on May 9, 2025, at the Delaney Hall Detention Facility. I have personally reviewed the evidence, including bodycam footage, firsthand accounts, and witnesses. The facts are clear: Representative McIver assaulted a law enforcement officer and has repeatedly shown a disregard for the rule of law,” the release continued.
On Tuesday, Habba announced that the Democrat lawmaker had been formally indicted by a federal grand jury. “Today a federal grand jury seated in Newark, New Jersey returned a three-count indictment charging U.S. Representative LaMonica McIver with forcibly impeding and interfering with federal law enforcement officers,” Habba posted on X.
Two of the counts carry a maximum federal prison sentence of up to eight years each, while a third carries a maximum of one year.
McIver, 38, first came to Congress in September in a special election after the death of Rep. Donald Payne Jr. left a vacancy in the Garden State’s 10th District. She was later elected to a full term back in November.
McIver has denied any wrongdoing and is sticking to her claim that she had lawful authority to enter the ICE facility. “I will not be intimidated. The facts are on our side. I will be entering a plea of not guilty… I look forward to my day in court,” she said in a statement released last month.
